Three Units, Not Four: What an Oakville Lot Allows

Oakville allows three homes on a residential lot as of right: the main house plus two additional dwelling units. On May 6, 2024, council voted 14 to 1 against a town-wide fourth unit, which was a condition of the federal Housing Accelerator Fund. A fourplex in Oakville still needs a rezoning or a variance for that specific property.

Five things decide most Oakville second-unit files:

  • The Building Code inside the house. In an older basement, ceiling height, the second exit and the fire separation between units usually decide the layout long before zoning does.
  • Which by-law applies. Lots between Dundas Street and Highway 407 are zoned under the North Oakville By-law 2009-189; the rest of the town, south of Dundas and north of the 407, is under 2014-014. The unit and setback rules have to be read in the right document.
  • Inside or out back. One of the two additional units can sit in a detached building, such as a coach house over a garage, where the lot and servicing allow it.
  • Development charges. Second and third units are exempt from development charges under Ontario’s Development Charges Act. A new house on the same lot is not.
  • The permit fee. The Town charges $12.00 per m² for an accessory dwelling unit in 2026, well under the new-house rate.

◆ Before the drawings

Lot Size Sets the House Size in Oakville's -0 Zones

South of Dundas Street, most Oakville houses are zoned under By-law 2014-014. Many lots in the established neighbourhoods carry a -0 suffix, and that suffix changes the design brief. It caps the floor area of the house as a share of lot area: 55% on a lot of 450 to 550 m², 45% at 850 to 950 m², and 33% once the lot reaches 1,450 m².

The -0 rules go further than floor area. Habitable space is not allowed above the second storey, a sloped roof is capped at 10.0 m and a flat roof at 8.0 m, and balconies or uncovered platforms above the first floor are not permitted. Lot coverage for a detached house is held at 35% or less, depending on lot size and how tall the house is. The suffix appears after the zone symbol on the zoning maps in Part 19 of the by-law, so it is quick to confirm before an offer or a design brief.

On a big lot, the cap is often smaller than buyers expect, so the floor area numbers should come off the survey before any elevation is drawn. It is the first check any Oakville building permit consultant should make.

If the design needs relief, the Committee of Adjustment decides. The 2026 fee is $4,303 for most applications and $2,152 for smaller residential items such as a deck, a pool or an accessory building under 15 m². The Town reviews the application for zoning first. Owners can waive that review, but any variance it would have caught is then theirs to fix.

Creek Valleys, Mature Trees and the Site Alteration Permit

Most Oakville house projects need at least one approval from an office other than Building Services.

Site alteration. The Town’s Development Engineering group issues a site alteration permit for every teardown rebuild, for pools, retaining walls and landscaping, and for additions that go outside the existing footprint. It covers grading and drainage, so the grading plan has to be ready when the permit drawings are.

Private trees. Private Tree Protection By-law 2017-038 requires a permit to remove or injure a private tree more than 15 cm in diameter at breast height. On a mature Oakville lot there is usually at least one tree inside the work zone or its protection area.

Pools and driveways. A backyard pool goes through Development Engineering rather than Building Services: a site alteration permit for the excavation and grading, and a pool enclosure permit for the fence. Widening a driveway at the curb needs its own permit for the work in the road allowance.

Grading sign-off. At the end of the job, an engineer or surveyor stamps a certificate confirming the finished grading and drainage follow the approved plan and do not harm the neighbouring lots.

Creeks. Sixteen Mile Creek, Bronte Creek and the smaller creeks that cross south Oakville are regulated by Conservation Halton, which issues its own permit for work in or near their valleys and floodplains.

Heritage. Designated houses, including every property in the Old Oakville, First and Second Street, Trafalgar Road and Downtown Oakville heritage conservation districts, need a heritage permit for most exterior work. The Heritage Oakville Advisory Committee meets monthly, and the Town’s 2026 schedule shows about four to seven weeks from submission deadline to decision.

A teardown rebuild pays twice before construction starts: the demolition permit for the old house and the floor-area fee for the new one. The site alteration permit, tree permit and any variance are separate charges from other departments, and a new house also pays Town and Halton Region development charges when the permit is issued. We quote our own fee for drawings and coordination after seeing the lot and the survey.
